1. Authority to apply
You confirm that you are authorised to request the opening of a credit account with Auckland Tyres Limited and to accept this Security Agreement & Authorisation on behalf of the applicant.
2. Business purpose
You confirm that the applicant is acquiring goods and services for the purposes of a business and not for personal, domestic or household use.
3. Credit & information authorisation
You authorise NCP Tyres Limited trading as Auckland Tyres to collect, use and disclose information about the applicant and its directors, owners and/or representatives for the purposes of assessing this request and any subsequent credit application, carrying out credit checks, ongoing account administration and credit monitoring, and debt recovery and enforcement if required. This may include obtaining and exchanging information with credit reporting agencies, trade references and debt collection agencies in accordance with the Privacy Act 2020.
4. Future account terms acknowledgement
You acknowledge that, if approved, any credit account will be subject to Auckland Tyres Limited's full Terms of Trade, which will be provided with the application documentation.
5. Payment understanding
You acknowledge that standard trading terms include payment due on or before the 20th day of the month following invoice, unless otherwise agreed in writing.
6. Pricing acknowledgement
You acknowledge that all pricing is typically exclusive of GST and may exclude freight, installation, call-out, travel and other applicable charges unless stated otherwise.
7. Ownership of goods
You acknowledge that, if a credit account is approved, goods supplied will remain the property of Auckland Tyres Limited until paid for in full, and that a security interest may be registered in accordance with the Personal Property Securities Act 1999.
8. Product responsibility
You acknowledge that products (including tyres) must be fitted, installed and used in accordance with manufacturer recommendations and applicable safety standards, and that improper use may void any claim.
9. CGA (business transactions)
Where the applicant is acquiring goods or services in trade, you acknowledge that the Consumer Guarantees Act 1993 may be contracted out of to the extent permitted by law.
